Türkiye örneğinde cumhurbaşkanlığı hükümet sisteminde yasama ve yürütme ilişkileri

Abstract

Yasama , yürütme ve yargı organlarının bütününden oluşan devlet yapıları; siyasal rejimler ve hükümet sistemleri aracılığıyla var olurlar. Bu tez çalışmasında ilk olarak kuvvetler ayrılığına dayalı hükümet sistemleri tarihsel arka planlarıyla incelenmiştir. Ardından Cumhurbaşkanlığı Hükümet Sistemine geçiş fikrinin tarihsel arka planı incelenmeye çalışılmış ve Türkiye‟nin yakın siyasi geçmişinde var olan hükümet sistemleri ele alınmıştır. 2017 yılında yapılan anayasa değişiklikleri ile birlikte Türk tipi Cumhurbaşkanlığı Sistemi kabul edilmiş ve yapılanma dönemi başlamıştır. Kararnameler aracılığyla yapılanan yeni hükümet sistemi; halen daha muhalefet tarafından ciddi eleştirilere maruz kalmaktadır. Çalışma esasen Cumhurbaşkanlığı Hükümet Sisteminin ne olduğu ve klasik hükümet sistemleri arasında nereye konumlandığını anlayabilmek adına hazırlanmıştır. Ayrıca sisteme yönelik yapılan eleştirilere bazı önerilerde bulunulacaktır.

State structures consisting of all legislative, executive and judicial organs; They exist under political regimes and systems of government. Firstly In this thesis, government systems based on the separation of powers have been examined with their historical background. Then, the historical background of the idea of transition to the Presidential System of Government was tried to be examined and the government systems existing in Turkey's recent political past were discussed. With the constitutional amendments made in 2017, the Turkish-style Presidential System was accepted and the structuring process started. The new government system structured by decrees; it is still subject to serious criticism by the opposition. The study was mainly prepared in order to understand what the Presidential Government System is and where it is positioned among the classical government systems. Also, some suggestions will be presented in response to these criticisms.
