6360 sayılı kanunun kamu hizmetlerinin sunumuna etkisi : Denizli Büyükşehir Belediyesi örneği

Abstract

6360 sayılı On Dört ilde Büyükşehir Belediyesi ve Yirmi Yedi ilçe Kurulması ile Bazı Kanun ve Kanun Hükmünde Kararnamelerde Değişiklik Yapılmasına Dair Kanun ile yerel yönetim sisteminde, Türkiye‟deki büyükşehir belediyesi sayısı arttığı gibi belediyelerin yetki ve sorumlulukları, hizmet sundukları alanların sınırları da değişmiştir.Hiyerarşinin en üst düzeyde olduğu merkeze bağlı yönetim sistemindeki sert yönetim bürokrasisinden uzaklaşmayı, hizmet sunumu kararlarının daha yerel sorunlara hitap etmesini amaçlayan, sunulan hizmetlerin direk Devlet eliyle yapılması anlayışından uzaklaşmayı hedefleyen 6360 Sayılı Kanun büyükşehirolan illerde herkesin kamu hizmetine ulaşmasını, kamu hizmetinin her bireye eşit miktarda sunulmasını amaçlamaktadır.6360 Sayılı Kanun ile Denizli ilinde yerel yönetim yapılanması değişmiş,2 adet yeni merkez ilçe kurulmuş, köylerin ve belde belediyelerinin tüzelkişilikleri olan muhtarlıklar ve belediye başkanlıkları kapatılmıştır. Köy ve beldeler mahalleye dönüştürülmüş, büyükşehir belediyesinin hizmet sınırları il mülki sınırları olarak belirlenmiştir. 6360 Sayılı Kanunun Denizli ilinde, büyükşehir ve ilçe belediyeleri tarafından sunulan kamu hizmetlerinin üzerindeki etkilerini araştırmak amacıyla 38 belediye yöneticisi ile anket çalışması yapılmış, toplanan veriler SPSS Statistics 22 WiN programı ile değerlendirilmiş ve 6360 Sayılı Kanun ile yeni büyükşehir belediyelerinin kurulması, büyükşehir belediyelerinin hizmet sınırlarının il ve ilçe sınırlarına genişlemesi idari ve hizmet sunumu açısından olumlu bir gelişme olduğu hipotezi test edilmiştir.

With the Law No. 6360 on the Establishment of the Fourteen Large Metropolitan Municipalities and Twenty-seven Districts and the Amendment of Certain Laws and Decrees on Decree Laws, the authorities and responsibilities of the municipalities as well as the boundaries of the areas they have served have changed in the local administration system as well as the number of metropolitan municipalities in Turkey. Law No. 6360, aiming to move away from the hard-line management bureaucracy in the centralized hierarchy of the hierarchy and address service- livery decisions to more local problems, aims to move away from the direct state-made understanding of the services offered. In the metropolitan provinces, everybody has access to public service. With the Law No. 6360, the local administration structure in Denizli has changed, 2 new central districts have been established and the headmen and mayorships, which are the legal entities of the villages and municipalities, have been closed. The villages and towns were conv erted into neighborhoods, and the service boundaries of the metropolitan municipality were determined as provincial boundaries. In order to investigate the effects of the Law No. 6360 on the public services provided in metropolitan cities and districts in Denizli, a questionnaire survey was conducted with 38 municipality administrators and the collected data were evaluated with the SPSS Statistics 22 WIN program and the establishment of new metropolitan municipalities with the law numbered 6360, The hypothesis that expansion to its borders is a positive development in terms of administrative and service delivery has been tested.
