Abstract: | Günümüz ekonomi sistemlerinde mal üreten ve hizmet sunan iki
temel birim vardır: Özel kesim ve kamu kesimi. Özel kesim, bireysel
fayda sağlayan mal ve hizmet sunarken, kamu kesimi, toplumsal
fayda ve pozitif dışsallık sağlayan mal ve hizmet sunmaktadır.
Zaman zaman sosyal, ekonomik ya da yönetim sistemleri sebebiyle
kamu sektörünün özel mal ve hizmet sunduğu da görülmektedir.
Devletin sunduğu hizmetler, hizmetin sunuş şekli, hizmetin hedef
kitlesi ve ekonomik yansımasına göre çeşitli sınıflandırmalara tâbi
tutulabilir. Bunların en bilineni; tam kamusal, yarı kamusal ve özel
mal ve hizmetler sınıflandırmasıdır.
Literatürde adalet hizmetleri çoğunlukla tam kamusal mal ve hizmet
bağlamında değerlendirilir. Bu noktada, “adalet hizmeti”
kavramından ne anlaşılması gerektiği önemli olmaktadır. Bu
çalışmada, öncelikle terminolojik bakış açısı kullanılarak adalet
hizmetlerinin kavramsal çerçevesi oluşturulacak ve adalet
hizmetlerinin hukuki ve ekonomik niteliği tartışılarak bu hizmetlerin
kamusal mal ve hizmet sınıflandırması içindeki yeri belirlenmeye
çalışılacaktır. Daha sonra, adalet hizmetlerinde etkinliği belirleyen
faktörler ve uygulamadaki mevcut durum incelenecektir. Ayrıca bu
çerçevede, bu hizmetlerin sunumunun, merkezi bütçe üzerindeki yükü
ele alınacaktır. Son olarak da Türkiye’de etkin bir adalet hizmeti
sunumunun oluşturulması için yapılması gerekenler belirtilecektir. At the current economic systems, there are two main units which produce goods and provide services: Private sector and public sector. While private sector provides goods and services that satisfy individual benefits, public sector provides goods and services that offer social benefits and positive externalities. Occasionally, it is also seen that public sector provides private goods and services because of social, economic and management systems. Services provided by State can be subjected to various classifications according to the provision, target group and economic reflection of services. The best known of them is classification of pure public, semi public and private goods and services. In the literature, justice services are mostly viewed in the context of pure public goods and services. At this point, it becomes important what should be understood from the concept of “justice service”. In this study initially, a conceptual context of justice services will be built up by using terminological perspective and the attitude of these services in classification of public goods and services will be tried to define by discussing the economic and judicial qualification of justice services. Next, the factors that determine the efficiency in justice services and the current condition in the implementation will be examined. Also in this framework, the burden of these services’ provision on central budget will be mentioned. Finally, what should be done for constructing an efficient provision of justice services in Turkey will be pointed out. |
